ROADSIDE DEVELOPMENT AND BEAUTIFICATION' LEGAL AUTHORITY AND METHODS PART 1

CURRENT INTEREST IN DEVELOPMENT AND BEAUTIFICATION OF THE ROADSIDE SEEMS TO INDICATE AMERICANS MATURING OUTLOOK AND UNDERSTANDING OF THEIR HIGHWAY SYSTEM. FROM THE EFFORT TO PRESERVE THE NATURAL AND MAN-MADE BEAUTY WHICH IS TO BE SEEN BY THE HIGHWAY TRAVELER, TWO MAIN LINES OF BENEFIT RESULT. ONE GROUP OF BENEFITS ACCRUES TO THE HIGHWAY ITSELF THROUGH MORE COMPLETE ACHIEVEMENT OF THE EFFICIENCY, SAFETY, COMFORT AND CONVENIENCE WHICH PLANNERS AND DESIGNERS ORIGINALLY VISUALIZED WHEN THE HIGHWAY WAS LAID OUT. THE SECOND GROUP OF BENEFITS ACCRUES TO THE COMMUNITY AS A WHOLE BY ASSURING THAT THE HIGHWAY INFLUENCE ON ITS SURROUNDINGS IS NOT A BLIGHTING OR DIVISIVE ONE, BUT HAS AN EFFECT OF HARMONIZING THE HIGHWAY WITH ITS SURROUNDINGS, THUS STABILIZING OR ENHANCING THE AESTHETIC VALUES OF THE COMMUNITY. THE CONCEP- TUAL BASIS OF PLANNING AND DESIGNING FOR GREATER ROADSIDE DEVELOPMENT AND BEAUTIFICATION IS PRESENTED FOLLOWED BY A CAPITULATION OF LEGAL AUTHORITY TO USE THE POWER OF EMINENT DOMAIN AND THE POWER OF PUBLIC PURCHASE TO ACQUIRE LAND OR INTERESTS IN REAL PROPERTY FOR THESE PURPOSES AND THE EXISTING BASIS IN LAW FOR STATE HIGHWAY DEPARTMENTS TO ENLARGE THEIR LANDSCAPING ACTIVITIES IN CONNECTION WITH THE BUILDING OR OPERATION OF HIGHWAYS.
