EL EQUILIBRIO ECONOMICO EN LAS CONCESIONES DE OBRAS PUBLICAS
ECONOMIC BALANCE IN PUBLIC WORKS CONCESSIONS
En este articulo se aborda la problematica relativa al equilibrio economico de las concesiones de obra que dista mucho de ser un tema claro y pacificamente admitido. El TRLCAP (Texto Refundido de la Ley de Contratos de las Administraciones Publicas) solo menciona este derecho en relacion con las modificaciones impuestas por la Administracion, y en el Anteproyecto conocido de la Ley Reguladora de Concesion de Obras Publicas se amplia a los supuestos encuadrables como "factum principis". No obstante, la mayor novedad del nuevo texto legal reside en la implantacion de un sistema "bidireccional" en el que el riesgo y ventura es corregido tanto en beneficio del concesionario como de la Administracion. Por otra parte, la forma en que el Anteproyecto aborda esta cuestion -fundamental, por demas, para el contratista- dista mucho de ser satisfactoria. Primero, porque el texto es confuso en su redaccion y, segundo, porque no incorpora algo tan esencial como el principio de remuneracion suficiente del concesionario. (A). Resumen en ingles: This article considers the problem of economic balance regarding public work concessions. This being a matter which is far from clear and one which is not readily admitted. The Revised Text of the Public Contract Law (TRLCAP) only mentions this right in relation to the modifications imposed by the Administration, though in the draft law of Public Works Concessions this is extended to cases of force majeure. However, the main innovation of the new legislation lies in the introduction of a "bi-directional" system in which risk and venture is corrected to the benefit of both the concessionaire and the Administration. However, the manner in which the draft law tackles this question, which is of utmost importante to the contractor, is far from satisfactory. This problem arises due to the confused wording of the draft and as a result of its failure to incorpórate essential factors such as the sufficient remuneration of the concessionaire. (A).
