Der Funktionsbauvertrag in Konzeption und Anwendung / The principle and application of the functional construction contract

Funktionsbauvertraege umfassen die Herstellung und Erhaltung von Bauwerken ueber einen Zeitraum von mehreren Jahrzehnten. Sie bieten damit eine erweiterte Vertragsform, um dem Strassennutzer leistungsfaehige Verkehrswege bereitzustellen. Dabei sind an die fertige Strassenoberflaeche funktionale Anforderungen gestellt. Diese werden in Jahresintervallen ueberprueft. Fuer die dauerhafte Bereitstellung des vereinbarten Zustands ist der Auftragnehmer, die Strassenbaufirma, verantwortlich. Die Vertragsform bietet ihm Moeglichkeiten, dieses mit innovativen Produkten und Verfahren umzusetzen. Nach einer Darstellung dieses Vertragskonzepts erfolgt die Darstellung der Umsetzung eines Funktionsbauvertrags aus strassenbautechnischer Sicht am Beispiel der Bundesautobahn A31. Hier wurden Schichtenaufbau und Materialwahl durch den Auftragnehmer auf Basis ausfuehrlicher Voruntersuchungen vorgeschlagen und umgesetzt. Der Auftragnehmer fuehrt auch wesentliche Teile der Qualitaetsueberwachung durch. Abschliessend werden Schlussfolgerungen dargestellt. ABSTRACT IN ENGLISH: Functional construction contracts cover the construction and maintenance of structures over a period of several decades. They therefore constitute an extended form of contract for the work required to provide road users with high-performance infrastructure. They include functional specifications regarding the finished road surface. Checks are carried out annually to make sure that these specifications are being met. The contractor, i.e. the road construction company, is responsible for ensuring that the road conforms to the agreed specifications on a permanent basis. This form of contract gives the constructor the opportunity to do so using innovative products and techniques. Following a detailed description of the concept behind the contract, this paper shall illustrate how the functional construction contract is applied from a road construction point of view using the example of the A 31 motorway. For this project, the structure of the courses and the selection of material was proposed and implemented by the contractor on the basis of detailed preliminary studies. The contractor is also responsible for significant parts of the quality control system. Finally conclusions will be drawn. (A)
