Liegt auch kuenftig noch Gefahr im Verzug? Zur Eilanordnung einer Blutentnahme durch die Strafverfolgungsbehoerden / Will the danger in delay remain? About speedy ordering of blood sampling by prosecuting authorities and the police

Bei Verdacht von Trunkenheitsdelikten im Verkehr beeintraechtigt jedes Zuwarten wegen des unmittelbar nach Trinkende einsetzenden Abbaus des Blutalkoholgehalts die Rueckrechnung der Blutalkoholkonzentration (BAK) zum Tatzeitpunkt. Eventuell wird eine solche sogar unmoeglich. Fuer eine Blutentnahme muss von den Strafverfolgungsbehoerden daher wegen Gefahr im Verzug gemaess Paragraf 81a Absatz 2 Strafprozessordnung (StPO) (gegebenenfalls im Vernehmen mit Paragraf 46 Absatz 4 Ordnungswidrigkeitengesetz (OWiG)) in der Regel eine richterliche Anordnung nicht eingeholt werden. Dies entspricht auch den Massstaeben, welche das Bundesverfassungsgericht in seiner Grundsatzentscheidung vom 12. Februar 2007 zu Paragraf 81a Absatz 2 StPO aufgestellt hat. (A) ABSTRACT IN ENGLISH: In cases of suspected drink driving, any delay affects the result of blood tests. Due to the quick decline of the blood-alcohol-concentration it is important to specify the level of alcohol in the blood as near as possible to the offence, as it may become impossible in some cases. Therefore, in general, the prosecuting authorities and the police do not need a court order (pursuant to paragraph 81a section 2 of the Criminal Procedure Code and paragraph 46 section 4 of the Regulatory Offences Act) for the blood test. This view is in accordance with the landmark decision on paragraph 81a section 2 of the German Constitutional Court from 12th February 2007.
