SOME OF THE CAUSES OF DIVERGENCIES OF VALUE OPINIONS

THE PROBLEM OF DIFFERENCES OR DIVERGENCIES IN THE EXPRESSED OPINIONS OF VALUE IS REPLETE WITH INBALANCES, DISTORTIONS, CROSS-CURRENTS AND CONTRADICTIONS. APPRAISERS, ATTORNEYS, AND THE COURT SPECIALIZING IN VARIOUS ASPECTS OF EMINENT DOMAIN PROCEDURES HAVE CONSISTENTLY ENDEAVORED TO DETERMINE THE CAUSES AND PREVENTION OF THESE DIVERGENCIES OF OPINION. IT MUST BE DEFENDED THAT NOT ALL DIVERGENCIES ARE INTENTIONAL OR IMMORAL. THE APPRAISER IS AN ADVOCATE OF HIS OPINION, BUT NOT AN ADVOCATE OF THE POINT OF VIEW OF HIS CLIENT. THE LIKELIHOOD OF TWO OR MORE APPRAISERS FINDING IDENTICAL VALUE IS REMOTE. ESTIMATES SOMETIME VARY BECAUSE OF THE LEGAL CONCEPTS, VAGUENESS OF THE LAW, COURT DECISIONS, JURISDICTIONAL ROLES, LOCAL PRACTICES AND THE JUDGES DISCRETION ON RELEVANT EVIDENCE FOR THE SAKE OF EXPEDIENCY. THE VERDICT OF A JUDGE OR JURY DOES NOT DISPROVE THE VALIDITY OF A VALUE CONCLUSION, IF BASED ON JUSTIFIED AND SUPPORTABLE CONSIDERATIONS. THE CHANGES IN THE LAST FEW YEARS IN SOCIAL, ECONOMIC AND POLITICAL FORCES MUST BE INTERPRETED TO CHANGES IN MARKET PRICES, LOAN POSSIBILITIES, EQUITY FINANCING, TAX ADVANTAGES AND CAPITAL GAINS, MARKET TRENDS AND FACTORS THAT INFLUENCE THE SELLING PRICES, ZONING REGULATIONS AND REQUIREMENTS, PLANNING REFINEMENTS, CONSTRUCTION COSTS, SCIENTIFIC AND ENGINEERING IMPROVEMENTS IN DESIGN, TRANSPORTATION FACILITIES, MASS DEVELOPMENT OF PROPERTIES AND OTHER ECONOMIC REALITIES OF PRESENT DAY LIVING.
