This article attempts to compare and contrast the present regulatory structure concerning discrimination with the application of the antitrust laws to the same topic. The background on discrimination is reviewed, and a definition is given of transportation discrimination. The application of transportation law to discrimination, and discrimination in antitrust laws are discussed, and the application of antitrust case law to discrimination is described. It is noted that there is some question that antitrust laws are really an alternative to existing transportation laws on discrimination. It is also not clear that antitrust doctrine will automatically protect the public interest.
