AN ANALYSIS OF UTILITY USE OF HIGHWAY RIGHTS-OF-WAY IN UTAH

A STUDY WAS CONDUCTED TO DETERMINE: (1) THE DEGREE OF USE OF PUBLIC RIGHTS-OF-WAY BY EACH UTILITY IN THE STATE OF UTAH, (2) WHETHER THERE ARE ANY REAL ADVANTAGES WHICH ACCRUE TO UTILITIES FROM THE USE OF ROADS AND STREETS FOR RIGHTS-OF WAY PURPOSES, AND (3) THE ECONOMIC IMPLICATIONS OF THE VARIOUS POLICY ALTERNATIVES. THE ANALYSIS CONSISTS OF: (1) PRESENTATION OF THE DATA COLLECTED INCLUDING A HISTORY OF HIGHWAY USE BY UTILITIES AND A REVIEW OF ESTABLISHED POLICY AND RECENT LEGISLATIVE AND JUDICIAL ACTIONS RELATED TO RELOCATION COST POLICY, (2) A COMPARISON OF UTILITY COSTS AND BENEFITS RESULTING FROM THE USE OF PUBLIC RIGHTS-OF-WAY BY THE SEVERAL UTILITIES, AND (3) CONSOLIDATION OF ALL THE DIFFERENT ECONOMIC CONSIDERATIONS. DATA USED IN THE ANALYSIS WERE THE NUMBER OF MILES ROADS AND STREETS BY ELECTRIC, TELEPHONE, NATURAL GAS, WATER AND SEWAGE UTILITIES IN UTAH. THESE DATA WERE OBTAINED THROUGH SAMPLES, MAPS, QUESTIONNAIRES AND PERSONAL INTERVIEWS. IT WAS DETERMINED THAT THERE ARE BENEFITS AND COSTS WHICH ARE CERTAIN TO BE ASSOCIATED WITH UTILITY USE OF THE PUBLIC RIGHTS-OF-WAY. THE COSTS INCLUDE THE MARRING OF LANDSCAPE AND REDUCTION IN TRAFFIC FLOW. THE BENEFITS INCLUDE (1) LOWER RATES AND HIGHER INPUT, (2) LOWER MAINTENANCE COSTS, (3) LOWER CONSTRUCTION COSTS, AND (4) BETTER UTILIZATION OF SCARCE RESOURCES. THE SCOPE OF THIS STUDY DOES NOT INCUDE FORMULATION OF POLICY REGARDING THE USE OF ROADS AND STREETS BY UTILITIES FOR RIGHT-OF-WAY PURPOSES, BUT RATHER IT IS AN ASSEMBLY OF FACTS WHICH ARE NEEDED BY THOSE WHO MUST DETERMINE POLICY. /VHRC/
