IMPLEMENTATION OF LAND USE POLICY: POLICE POWER VS. EMINENT DOMAIN

WHETHER THE POLICE POWER OR THE POWER OF EMINENT DOMAIN SHOULD BE USED TO IMPLEMENT PROJECTS SEEKING TO MOLD THE ENVIRONMENT IN THE PUBLIC INTEREST, IS A QUESTION OF ULTIMATE IMPORTANCE, NOT ONLY TO THOSE WHOSE PRIVATE PROPRIETARY RIGHTS ARE AT STAKE, BUT TO THE PUBLIC IN GENERAL. THE BASIC NATURE OF THESE POWERS AS WELL AS THE PRINCIPLES THAT CONTROL THEIR USE ARE ANALYZED SUGGESTING THAT A NEW RATIONALE BE USED TO DETERMINE THE APPROPRIATE CRITERIA TO GUIDE FUTURE POLICY. /AUTHOR/
