LEGAL PROBLEMS AND CONCERNS ASSOCIATED WITH HISTORIC PRESERVATION

The original legislation for the bridge replacement program provides only for replacement, not repairs, thus contributing to the loss of many historically significant bridges which could have been rehabilitated to provide continued modern transportation service. Another significant legal impediment to preserving historic structures occurs when the AASHTO standards adopted by FHWA are applied too inflexibly.
