Transportation Tort Liability Travels Up the Supply Chain
There should be awareness in the transportation marketplace that action will be required to accommodate increased risk exposure in evolving case law. Third party logistics (3PL) business models and economic assumptions will have to materially change if tort liability imputation is included in that adjustment. Innovative insurance developments may, on one hand, be required by this change. 3PL growth facilitation into even larger economic units that are the only units capable of such risk accommodation, on the other hand, may thereby further supply chain control centralization into fewer and fewer 3PL entities' hands.
