PERMISSIBLE ALCOHOL LEVELS AND DRUNKEN DRIVING

ALKOHOLTOLERANZ UND TRUNKENHEIT AM STEUER

Material arising from 199 paired cases accused of drunken driving is examined. One group had been charged in the normal way, after they had been noticed by the police following an accident or a similar accurrence. The other group consisted of persons who had been caught by chance in accordance with paragraph 13 tests. It was hoped to obtain clarification as to whether these groups are distinguishable as regards the effects of alcohol for the same level of blood alcohol content. The material shows that for 67 pairs, the results did not correspond. Of these 34 proved not to be influenced by alcohol in the paragraph 13 cases and alcohol influenced in the remaining cases, whilst 33 pairs gave the opposite results. It was concluded that persons who are accused of drunken driving under normal circumstances do not differ significantly from drivers in general in respect of their alcohol tolerance.
