LEGAL ASPECTS OF CONDITION ASSESSMENT AND REPORTING. IN: STRUCTURAL CONDITION ASSESSMENT

This chapter describes how structural condition assessments (SCAs) present many challenges to the professionals who perform them. Although the structure being assessed already exists, SCAs create new legal risks for those who perform them. Successful consultants recognize that risks arising out of SCAs often exceed the anticipated profit. Recognizing this, they control the risks at each phase of the assignment. Every element of the assignment-from proposal to contract to report-is planned and executed carefully. This chapter examines the unique characteristics of SCAs and discusses strategies for managing the legal risks.
