ARBITRATION IN MARITIME DISPUTES

The use of arbitration to settle disputes resulting from collision, salvage, ship sale and purchase, chartering, shipbuilding etc., is reviewed. Some of the problems resulting from the use of the arbitration clauses are discussed. The paper is divided into three sections: (1) a reference in a bill of lading to a charter party containing an arbitration clause, (2) the time within which a claim may be brought, and (3) the arbitrators and the courts.
