LIABILITY FOR DELAY IN COMPLETION OF HIGHWAY CONSTRUCTION CONTRACT

This is a three-part paper concerned with legal liabilities for failure to complete a highway construction contract on time. The section on "Delay Caused by Contractee" deals with liability of the State for improperly interfering with or preventing the contractor from completing the contract on time. The second section, "Delay Caused by Contractor," deals with liability of the contractor for failure to complete the contract on time where the delay is not attributable to actions of the State. The third, "Work Stoppage Under Court Order," deals with a situation where work is halted by court order (numerous environmental cases) and it is frequently difficult to fasten fault for failure to complete the contract on time on either of the contracting parties. Numerous related and significant legal problems falling within the above areas are also discussed.
