RECREATIONAL BOATING PRODUCT ASSURANCE: THE CONSUMER PRODUCT SAFETY COMMISSION FOR BOATS

This article discusses the standards directed at manufacturers to ensure boating safety. The United States Coast Guard has authority to establish national construction and performance standards of boats and associated equipment. The statutes require that the Coast Guard consider the need for and the extent to which regulations or standards will contribute to boating safety and consider relevant available boating safety standards, statistics and data. The standards must be minimum safety standards in terms of performance. The Coast Guard also consults with the National Boating Safety Advisory Council, whose members include state boating law officials, representatives from the boating industry, and representatives from the boating public. The Council ensures that all boating safety regulations and standards are needed and reasonable. The Coast Guard monitors product recalls and is also authorized to require or permit the display of labels for the purpose of certifying compliance with federal regulations and safety standards for boats and associated equipment. Several educational and enforcement mechanisms are in place to assure the integrity of the manufacturer certification program, including manufacturer outreach, factory visits and compliance testing.
