AVOIDING CONSTRUCTION LITIGATION ON TRANSIT PROJECTS
Claims and disputes are not uncommon on major transit construction projects. If they are left unresolved, they can deteriorate relationships, play havoc with budget, delay project delivery and ultimately result in expensive, disruptive and adversial litigation. The purpose of this paper is to identify management strategies and options to avoid litigation. The Tri-County Metropolitan Transportation District of Oregon (TriMet) has been successful in reducing the number of claims and disputes on some major projects. The paper summarizes TriMet's experiences in claims on its major projects. The details of the experiences are shared to illustrate the effectiveness of the approach or option that TriMet utilized to avoid litigation.
