NUMBER OF STATES COMPLYING TO ALCOHOL LAWS IS UNDER 21
Many states could face federal highway funding penalties for failing to enforce driving while intoxicated (DWI) or driving under the influence (DUI) laws by October 1, 2000. Under the provisions of the Transportation Equity Act for the 21st Century, states must enact open container and repeat offender bills or they will have 1.5% of their apportioned NHS, STP, and Interstate Maintenance Funds transferred to their Section 402 highway safety program for each violation. Starting on October 1, the transferred amount increases to 3% for noncompliance with each provision. Through April 28, 19 states are in compliance with the open container requirement and 12 are in compliance with the repeat offender rule; eight states have met requirements for both.
