Highways built with warrantees are a difficult concept to establish in the U.S. Although various governmental entities realize the benefits of such warrantees, in terms of long-term maintenance costs, there have been 2 main stumbling blocks. The first has been difficulty in settling the public/private lines of delineation relating to control over road building design; and the second has been the overly litigious society in the U.S. Liability issues must be resolved. The federal government is working with the private sector to allow for compromise whereby industry can comfortably build a highway and governments can still achieve their desired goals. Various federal-state partnerships to provide highway improvements to the public that will come with a roadway performance warranty are being developed.
