THE ROLE OF MEDIATION AND CASE APPRAISAL IN THE RESOLUTION OF PERSONAL INJURY DISPUTES ARISING FROM MOTOR VEHICLE ACCIDENTS

The vast majority of personal injury disputes are settled before a court trial and settlements achieved at 'the door of the court' are commonplace. The dispute resolution processes of mediation and case appraisal provide opportunities for the settlement of disputes at an earlier date. This paper examines the use of the two processes within the litigation context. The benefits of the use of the processes are analysed and the appropriateness of the use of the processes in personal injury disputes is also critically examined.
