BUY AMERICAN REGULATIONS: CLEARING THE SMOKE

Buy American regulations (BA) for the transportation industry have always been subject to a lack of understanding. Revisions to the regulations have helped tremendously in clearing some understanding, but the transit agencies, prime bidders and the vendor community are still attempting to cope with these regulations. This paper provides a fundamental understanding of the origin and purpose of the regulation, as this is necessary prior to examining the process of compliance. It identifies the three statutory waivers permitted by BA requirements, and provides a review of Section 661.11 of 49CFR which sets forth the waiver from BA regulations for buses and other rolling stock, provided the cost of domestic components equals or exceeds 60% of the cost of all the components and the final assembly takes place in the United States. The disclosure and certification requirements for pre-award and post delivery audits are presented and penalties associated with inaccurate disclosure are also discussed. The paper concludes with issues related to maintaining the confidentiality of the information provided for BA audits and the future outlook of this regulation.
