PARKING LEGALITIES REFERENCE 10: FRAUD BY EMPLOYEES - THE LEGAL ISSUES FOR EMPLOYERS

This article is designed to inform parking company employers about the procedures that need to be in place to protect their business from fraud by their employees. In most cases, fraud will be a cause for dismissal, in which case the employer should follow all the legal steps required for fair dismissal. Each employee must be made fully aware of his company's disciplinary rules and procedures. The ACAS Code of Practice on Disciplinary Practice and Procedure is not legally binding, but should be followed as far as possible. The article outlines eight issues to be addressed in disciplinary procedures, which should also include a warning process. An employer may incur 'vicarious liability' for negligent acts by his employees which harm the public. Four legal cases of employer's liability are briefly discussed. The Public Disclosure Act aims to encourage employees to speak out against any kind of fraud or wrongdoing that they find in their workplace.
