BEYOND ADR: WORKING TOWARD SYNERGISTIC STRATEGIC PARTNERSHIP

Increasingly, disputes in the construction industry are being resolved via alternative dispute resolution (ADR). ADR can be an effective alternative to litigation; however, ADR comes into play after disputes have already arisen. A key factor in successful projects is establishing relationships with parties that are driven to resolve issues before they become disputes. This paper outlines four levels of partnering--moving from a traditional adversarial relationship to a synergistic partnership built on trust and long-term goals. The authors explain the theory of partnering relationships and provide practical examples of projects on which such relationships were successful. The paper concludes with 10 tips for understanding and applying the concepts.
