ELECTRONIC VEHICLE TRACKING

Electronic vehicle tracking is a means of locating the position of a vehicle and tracking its movement by the use of a transmitter or transponder attached to that vehicle. It has a number of applications in the areas of law enforcement, tracking by private investigators, fleet management and traffic management. There is a threat to personal privacy arising from both the act of surveillance when consent is not obtained and the collection and use of information generated by that surveillance. This report suggests that the threat posed by law enforcement agencies justifies an act of legislation which sets out the manner in which such tracking may be carriedout. The report also makes recommendations on legislation that will be able to control unjustifiable invasions of privacy involving electronic vehicle tracking by bodies and individuals other than law enforcement agencies.
