This Transportation Law Journal Note comments on the effect of airline deregulation on labor relations. Section I explores some of the problems in airline labor relations which have arisen since deregulation. Topics covered include air traffic control staffing, the current state of the airline industry, and the significance of the Railway Labor Act, which was extended by Congress to cover employees of airlines engaged in interstate commerce. Section II addresses mergers. Before deregulation, the Civil Aeronautics Board was charged with approving mergers while at the same time assuring fair and equitable treatment of all employees affected by the merger. Following deregulation, authority to challenge mergers was given to the Department of Justice whose primary focus is on antitrust implications of airline mergers. The Department of Justice has no authority to examine the interests of affected employees or invoke labor protection provisions. Section III discusses the effects of deregulation on labor relations when an airline files for bankruptcy. Topics addressed are (A) the rejection of collective bargaining agreements, (B) Section 43 of the Airline Deregulation Act, (C) employee protection in route transfers, (D) the importance of seniority, and (E) age discrimination claims. Section IV, Cabotage, looks at the status of U.S. airline employees with respect to foreign ownership of their company. Section V examines air transportation safety under deregulation. Topics discussed here include (A) substance and alcohol testing of airline employees and (B) flight attendant duty time limits. Section VI, in conclusion, states that moderate government intervention designed to establish a harmonious and stable work environment for aviation employees will be a step toward reaching the goal of protecting public interest and safety.
