OVERVIEW OF CURRENT EC DEVELOPMENTS AND REGULATIONS OF CONCERN TO PUBLIC TRANSPORT

This article presents three European Community (EC) Directives relevant to the operation of public transport services. Directive 90/531 (17 September 1990) requires invitations to tender to be issued on an EC- wide basis for certain supply and building contracts in the transport sector. Directive 92/13 (25 February 1992) has coordinated the legal and administrative arrangements, established by 90/531 for common action regarding contract-awarding procedures. With a few exceptions, both these directives applied throughout the EC with effect from 1 January 1993. Directive 93/38 (14 June 1993) may be described as 90/531, extended to cover service contracts that had temporarily been excluded. It will be effective from 1 July 1994, except in Greece, Portugal and Spain. It coordinates the procurement procedures followed by contractors in the water, energy and transport supply sectors, and requires EC-wide calls to be issued for tenders of sufficiently large supply, building and service contracts. The article includes a flow chart, indicating how to handle services of all types, and a diagram of the two-tier application of service categories.
