LAND USE PLANNING AND RELOCATION ASSISTANCE

The Uniform Relocation Assistance and Real Property Agcquisition Policies Act of 1970 applies uniform standards of benefits to all federal and federally assisted projects. The purposes of the act are to provide direct payment and advisory assistance to people displaced by a project and to assure them decent replacement housing. Compensation for moving expenses and benefits to offset increased housing costs is provided. There is an interagency task force that has issued guidelines for implementing the Act. Litigation involving the Act has mainly been challenges to agency determination of housing availability and adequacy. Subsequent cases discussing the intent of the Act, have held that relocation assurances must be provided for every parcel of the property and that as long as a state keeps open the option of receiving federal funds it must comply with the Act. Land use planning has substantial environmental, social and economic effects. Although serious legal questions can be involved there is no national policy on land use. Two acts that have an affect on federal aid highways are the Department of Transportation Act providing that park land cannot be used for highways unless nothing else is feasible and the Highway Beautification Act providing for removal of junkyards and advertising signs from highways. But more comprehensive land use policies and controls are necessary. Several bills have been brought before Congress towards this end. The development of highway and other public works is being restricted by legal requirements, such as those for location and eventually land use, to check the potential adverse impact of such projects.
