NOISES IN THE HOUSE OVER RUBBER IN THE ROAD
A provision in the 1991 Intermodal Surface Transportation Efficiency Act requires states to use crumb rubber in 5% of the asphalt tonnage laid in 1994. The % must rise to 10% in 1995, 15% in 1996 and 20% in 1997 and succeeding years. If a state fails to meet these benchmarks, the U.S. Department of Transportation will withhold a share of the state's federal apportionments equal to that year's percentage. However, it is noted, the American Association of State Highway and Transportation Officials and the National Asphalt Pavement Association want changes or relief from the provision. An AASHTO survey found that crumb rubber modified hot mix asphalt is 50% to 100% more expensive than regular hot mix asphalt, and NAPA wants more research on the issue or waiver of penalties until Congress approves new research. Arguments for and against this issue are discussed briefly.
