The author compares America's Carmack Amendment to Canada's Conditions of Carriage law. Carmack is a strict liability provision which means that it limits severely a carrier's defenses to a cargo loss or damage claim. Carmack tends to make the carrier liable not only for the transportation, but also the packaging of goods. The article explains Canada's liability provisions and argues for a revamping of the Carmack Amendment to make it more equitable for shippers.
