TESTING APPLICANTS FOR ALCOHOL AND DRUG ABUSE

Article discusses the various aspects to employer testing of applicants for drug and alcohol abuse. Areas discussed are the different legal constraints for public versus private sector employers; unionized organizations; limitations on employers; handicap discrimination; arrest or police records; federal and state legislation and regulations. The article concludes that this issue continues to be controversial, and the courts are still setting the law. However, the courts have generally granted employers more freedom to test job applicants than to test employees who are already working at the company.
