INJUNCTION OF TRAFFIC VIOLATIONS

An injunction should only be used when legal remedies are inadequate and substantial harm would result from continuing the activity. In a recent case an interstate trucking company violated an Iowa statute prohibiting double bottom trucks from operating on Iowa highways. This state was granted an injunction which was affirmed by the Iowa Supreme Court. The court reasoned the that the injunction was necessary because of the repetition of the violation. The author argues that this traffic violation was held to injure the public without the actual damages being considered. Also the constitutional aspects of the injuction were not considered.
