The paper discusses the legality of an Interstate Commerce Commission (ICC) ruling, 49 U.S.C. 11103(a) which empowers the agency to "require terminal facilities, including main-line tracks for a reasonable distance outside of a terminal owned by a rail carrier...... to be used by another rail carrier". The paper cites that there has been no precedent granting a railroad use of another railroad's tracks.
