MOTOR COMMON CARRIAGE AND THE FILED RATE DOCTRINE

Common carriers engaged in interstate motor transportation subject to the jurisdiction of the Interstate Commerce Commission (ICC) must file a tariff covering the authorized services which the carrier offers to the public. It is essentially a "price list" for transportation and related accessorial services. This article reviews the Interstate Commerce Act and how courts applied the "filed rate doctrine" as an undisputed rule. The industry changes as well as recent use of unfiled rates is discussed.
