This article discusses some typical claims made against design consultants and offers suggestions concerning what a firm can do to safely defend itself against liability claims. Some of the guides offered are: never perform work for a client without a clearly defined, written contract; document thoroughly the conditions and terms of the contract, design, and specifications, as well as your relationship and communications with client and contractor and the boundaries of your liability; give your client a realistic appraisal of what can be accomplished with the available monies, real estate, etc.; and designate someone within your firm to become an expert on quality control and loss prevention.
