NEW YORK STATE FOUND LIABLE FOR HAZARDOUS TRAFFIC CIRCLE
The New York State Department of Transportation was ruled to be 85 percent liable for injuries sustained by a motorist entering a traffic circle under foggy weather conditions. It was ruled that the DOT was aware of the hazardous condition at this particular circle because numerous complaints had been rendered to the DOT, but the DOT had not acted in a timely fashion to correct it and did not have signs warning motorists as to how far ahead the circle would be encountered nor at what speed one should be driving to enter it.
