PARTICIPATION AND LEGAL PROTECTION AT TRAFFIC MEASURES

Traffic signs, traffic signals and other traffic measures, for instance to restrain traffic in a residential or urban area, or to regulate traffic in an industrial area, can only be placed or removed by a decree of the local authority or national/provincial government. Legal protection against such decrees is therefore a legal protection against authority. This legal protection is regulated by different areas of Dutch legislation. Jurisdiction on this subject is reviewed here to find a certain consensus. Other examples studied are: the introduction of speed limits; traffic humps; urban cycle tracks or shopping centres. Public participation in these introductions is sometimes difficult, because it has no legal base. While the Dutch law for traffic and transport is being modified, recommendations are presented to introduce certain legal rules for public participation and legal protection for traffic and transport provisions and measures.
