NY TRUCK DRIVER KILLED IN UTILITY POLE ACCIDENT
The Appellate Division of the New York State Supreme Court recently ruled against the state when it found that the hazardous location of a utility pole on a curve was the proximate cause of a tractor trailer driver's death. The driver lost control of the tractor-tanker truck he was driving as he entered a reverse S-curve. The truck was carrying hot liquid asphalt. Evidence at the trial showed that the utility pole which the truck hit had been relocated in 1975 as part of a "spot" safety improvement program. However, according to a New York DOT memorandum, the relocation was unsatisfactory, with an engineer noting that the relocation position was just as hazardous as the old location. (Olson v.
