ENFORCEMENT PATTERNS
A recent Department of Transportation report on enforcement actions under the Hazardous Materials Transportation Act (HMTA) during FY 1987 shows significant patterns in enforcement, and provides an idea of the range of penalties that can be anticipated for specirfic violations. The predominant enforcement tool is the civil penalty authorized in 49 USC App. Sec. 1809. Each of the modal administrations within DOT is responsible for enforcement of hazardous materials regulations occurring within its mode. Penalties imposed in air transport, highway transport, rail transport, intermodal transport, and water transport are noted. Enforcement procedures are reviewed.
