$23 MILLION AWARDED TO SISTERS IN GRADE CROSSING SUIT
A Jury in Boulder County District Court awarded $18 Million in punitive damages and $5.2 million in compensatory damages to two sisters who were injured when their car was struck by a Burlington Northern train at an unprotected grade crossing. The award has subsequently reduced by 2 1/2% comparative negligence on the driver's part. The sisters had previously settled claims against the State of Colorado, the County of Boulder and the City of Longmont for $850,000. The article describes the suit brought against the railroad and the evidence presented at the trial.
