24TH ANNUAL TRANSPORTATION LAW WORKSHOP
The topics addressed by the workshop included the following: recent developments in transportation law, key issues in motor vehicle law, environmental cases, issues facing the U.S. Congress, design defects and tort liability, right-of-way settlements, and other topics. The recent developments in transportation law covered here included those in the area of highway safety (including legal drinking age requirements in bordering states, and the 55-mph study), the disadvantaged business enterprise program, bid rigging, the movement of hazardous materials, and the subject truck weight. In the area of motor vehicle law, three areas were addressed: mandatory seat-belt law, child restraints, and teenage driving. A panel on environmental cases updated law and cases concerning issues and the payment of attorney fees under Equal Access to Justice Act. The challenge to route H-3 in Hawaii was the subject of a slide presentation. Issues which Congress must address in passing the 1986 Federal Aid Highway Bill were identified as follows: demonstration projects, formula for apportionments, minimum allocations, "buy American", and the Interstate Cost Estimate (ICE). The control of right-of-way Settlements was the topic a presentation by a trial attorney. Other topics discussed included defense and indemnity of state employees in tort and constitutional issue cases, cable television permits, and relocation benefits.
