$6 MILLION AWARDED FOR INJURIES CAUSED BY LOW, DEFECTIVE SHOULDER DROP-OFF

A New York Court of Claims awarded more than six million dollars on October 24, 1985 to three claimants who brought suit against the State alleging that negligent road maintenance contributed to the death of one woman and severe injuries to another. The accident occurred on Route 208 in the town of Blooming Grove, Orange County, New York on September 14, 1978. State maintenance standards recommend that for a class B highway, such as Route 208, a one and one-half inch drop-off is acceptable. The drop-off at the accident site was three to six inches.
