RHODE ISLAND HIGH COURT SHIELDS DOT FROM MOTORIST INJURY CLAIMS

The Rhode Island Supreme Court recently denied and dismissed a plaintiff's appeal and ruled in favor of the State by arguing that the plaintiffs could not have been foreseen as "specific identifiable" victims of the State's negligence. The crux of this case was a distinction the court made, based upon prior cases and rulings, between public duty (owing to the citizenry at large) and special duty (owing to a specific, identifiable individual). The details of the accident are described and the testimony presented at the trial is discussed. The noteworthy elements of the justices' statements are also presented.
