N.J. SUPREME COURT UPHOLDS DOT IMMUNITY: ISSUES WARNING
The New Jersey Supreme Court recently reversed an Apellate decision and found the State immune from liability in a case that essentailly involves traffic sign placement. The details of the accident which occurred in Walken Hollow are described as well as the plaintiffs' case. The State asserted its immunity from the plaintiffs' claim under various provisions of the Tove Claims Act. The Court majority opinion and the dissent from the majority opinion are noted.
