FEDERAL PARTICIPATION IN STATE CONTRACT CLAIM AWARDS

The legal relationship between the principal parties is briefly reviewed, and an attempt is made to place the subject in perspective. The Federal-State project agreement (Form PR-2) and its implications are outlined, and some of the alleged problems are examined. Among claim items considered are: damages due to delay caused by a poorly timed SHD change order, and the eligibility for and extent of, Federal-aid participation in claim awards made by the State to Federal-aid contractors. Attention is directed to the statement that FHWA participation in claims and resultant settlements is the extent to which such settlements are grounded in contract provisions and specifications and actual costs incurred.
