EXCESSIVE EXTERNAL INTOXICATION AND ROAD ACCIDENTS

LE INTOSSICAZIONI ESOGENE VOLUTTUARIE E GLI INCIDENTI STRADALI

ARTICLE 132 OF THE ITALIAN HIGHWAY CODE HAS SINCE 1958, STIPULATED THAT IT IS FORBIDDEN TO DRIVE UNDER THE INFLUENCE OF ALCOHOL OR OTHER INTOXICATING SUBSTANCES, AND PROVIDES FOR VERY SEVERE PENALTIES IN THIS RESPECT. THE REGULATION IS HOWEVER INOPERABLE, SINCE ARTICLE 13 OF THE ITALIAN CONSTITUTION UPHOLDS THE INVIOLABILITY OF PERSONAL LIBERTY, THUS RENDERING BLOOD SAMPLING PROCEDURES IMPOSSIBLE. THE MEDICO-LEGAL ASPECTS OF THIS SITUATION ARE EXAMINED IN TERMS OF ROAD SAFETY, AND IN THE LIGHT OF BLOOD SAMPLING AND BREATHALYZER PROCEDURES OPERATING IN OTHER COUNTRIES. IT IS SUGGESTED THAT AGREEMENT TO SUCH PROCEDURES BE MADE A REQUIREMENT FOR OBTAINING A DRIVING LICENCE.
