ARRITRATION OF PUBLIC CONSTRUCTION CONTRACT CLAIMS IN CALIFORNIA

This reviews the first arbitration hearing conducted by the California Department of Transportation on a construction contract claim pursuant to the recent state legislation affording contractors the option of arbitration in lieu of the litigation of claims. What was hoped to be an inexpensive and speedy resolution of claims turned out, at least in this case, to be an expensive process, without allowance for proper discovery and a hearing that lasted twice as long as a cort trial on the same issues.
