REAL PROPERTY ACQUISITION AND RELOCATION ASSISTANCE IN NEW YORK

New York State acquires property for public purposes through an administrative process. The legal authority for this method emanates from the Eminent Domain Procedures Law (EDPL) of 1978. New York State Department of Transportation operates on full compliance with EDPL but derives specific authority to acquire property for new or reconstructed highways under Section 30 of the state's highway law. Prior to acquisition an opportunity for a public hearing of the proposed project and its impact must be provided. After the hearing, the engineering division prepares detailed construction plans and appropriation maps for each property affected by the project. The property owner may accept the full payment of damages or an advance payment and claim again within three years. Special attention is given to the displacement of residential and nonresidential occupants. Relocation benefits are also available for commercial occupants.
