BREATH TESTING AND POLICE ENFORCEMENT

At present the BAC of drivers suspected of having a BAC over the legal limit of 0,5% is measured by chemical test tubes and blood tests. This article looks into the possibilities of replacing these testing methods with other breath testing devices. Requirements are suggested and discussed. There are several ways of replacing test tubes, or blood test, or both. For roadside screening purposes other devices are probably available with more accuracy than the 0,5% test tubes. For screening at the police station any instrument which is designed for evidential purposes is suitable as a replacement for the 0,8% test tubes. The use of these devices will lower the probability of false negative outcomes of the screening process. By way of example it is shown that a result over 0,8% on a particular evidential device is sufficient proof of the actual BAC at the time of testing being over the legal limit of 0,5%. It is urged that a discussion be started on requirements and possible forms of application of other breath testing devices. (TRRL)
