THE OCCURRENCE OF ACCIDENTS AND LEGISLATION IN SWITZERLAND

UNFALLGESCHEHEN UND RECHTSPRECHUNG IN DER SCHWEIZ

The author reports on developments in road accidents in Switzerland. He notes a considerable rise in accident numbers, particularly a disproportionate increase in fatal accidents for 1977 compared to the previous year. He traces this increase back, in part, to a considerable decline in the numbers using seat belts. According to the results of a number of surveys, a great majority of the Swiss population is of the opinion that the currently valid blood alcohol limit of 0.8 is too high. The judiciary of the Swiss Federal Court has accepted, after further inquiries of its own, the results gained by medical science in Germany on the question of fitness to drive by the so-called "one for the road" drunks. The frustration caused by the blood-test according to Swiss law has been handled very firmly by the judiciary. The blood analysis values obtained by different methods deviate from each other by not more than 0.1 part per thousand and therefore, in the view of the Swiss federal court, they can be used without hesitation. The author refers to other judgments on the question of suspended sentences and on a case of imposition of costs in spite of acquittal where the alcohol level was under 0.8 parts per million. (TRRL)
