MEETING THE CHALLENGES OF ENVIRONMENTAL RESTRICTIONS IN THE VAIL PASS PROJECT (ABRIDGEMENT)

A contractor's view is presented of the problems encountered and the solutions developed during the Vail Pass construction project. The lack of understanding of environmental law among contractors and the Colorado Department of Highway's foresight in educating contractors on these laws before letting of the project is noted. The problem of unpredicatable costs and their reimbursement is discussed. The problem was solved by specifications under which the Department of Highways separated unpredictable costs from the normal contract items and paid for them on either a time and material basis or by bid hourly equipment rates. Regulations and procedures which imposed severe scheduling restrictions on contractors and ways in which these problems were resolved are described. It is noted that some work situations may dictate a different/and more valid procedure than the specified one.
