Public-Private Partnerships for Transportation: Categorization and Analysis of State Statutes

Currently 33 States, the District of Columbia and Puerto Rico have passed P3 legislation. This document analyzes current transportation public-private partnership (P3) laws by State. Eight tables are presented by topic: Table 1 includes State, statute type, year of enactment, authorized participants, and authorized projects; Table 2 covers high-level provisions including sunset provisions, conversion of existing roads to toll roads, term length limits, high-occupancy toll lanes or congestion pricing; Table 3 covers oversight and governance; Table 4 focuses on soliciting, accepting and reviewing proposals; Table 5 covers procurement and public participation; Table 6 and 7 address funding and finance; and Table 8 includes cost-benefit analysis, labor issues, and bankruptcy. Additional topics discussed include trends in P3 legislation, recently proposed legislation, benefits and concerns, and project delivery models.
